ATS Gift Card Terms & Conditions
Anderson Therapy Services Inc. (“ATS,” “we,” “us,” or “our”) issues prepaid gift cards redeemable for delivery of ATS Services (“Gift Cards”). These Terms & Conditions (“Terms”) govern purchase, ownership, redemption, replacement, and other use of Gift Cards. By purchasing, accepting, or using a Gift Card, you (“Purchaser,” “Recipient,” or “User”) accept these Terms. If you do not agree, do not purchase or use a Gift Card. “Services” mean the following fee-based service offered by ATS: Speech Language Pathology, Occupational Therapy, Physical Therapy, Mental Health, Behaviour Therapy, Psychological Assessments, Therapy Groups, and Parent Coaching.
1. Purchase of your Gift Card
Gift Cards may be purchased online, in person, or through authorized resellers. Gift Cards represent prepaid credit redeemable toward ATS Services. Gift Cards are not discounts, incentives, or referral rewards. All Gift Card sales are final unless otherwise required by law. Digital/e-Gift Cards are delivered to the email address or phone number provided at purchase. ATS is not responsible for delivery failures caused by incorrect contact details. Unless explicitly authorized in writing, Gift Cards may not be resold, auctioned, or otherwise marketed for value. ATS retains discretion over service availability and clinical requirements.
2. Learning about your Gift Card
Each Gift Card is loaded with the value shown at purchase, in the currency displayed. ATS provides written information at purchase, including fees, restrictions, and contact details. All Gift Cards include clear instructions for use.
3. Expiry, Dormancy
Dollar-value Gift Cards do not expire. As permitted by applicable law, Gift Cards that are restricted to provision of a certain Service (e.g. a “Physical Therapy Gift Card”) may expire if an expiry date is clearly stated at purchase. ATS does not charge dormancy, inactivity, or maintenance fees.
4. Eligible Services
Gift Cards may only be redeemed for the Services offered by ATS, and as permitted by these Terms. ATS reserves the right to exclude specific services from Gift Card payment (e.g., third-party vendor fees) and to change eligible Services with notice. Some Services require intake or assessment before delivery begins. Gift Cards do not guarantee appointment availability. All redemptions are subject to ATS’ Service-related policies and/or standards, including its booking, cancellation, and no-show policies.
5. Consent and Boundaries
Use of Gift Cards do not replace or modify informed consent requirements. Clinical decisions remain independent of payer or card value. Gift Card purchasers have no inherent rights to receive clinical information about a patient that they otherwise would not have.
6. Transferability
Cards are issued to a certain payer recipient unless otherwise specified. Transfers may be approved by ATS if the Gift Card has not been used.
7. Redemption Rules
Gift Cards must be presented when ATS asks for payment for the Services. Gift Card values are redeemable until the balance reaches zero. Gift Cards cannot be redeemed for cash except where required by law. Gift Cards cannot be used to purchase other gift cards.
8. Cancellation, Refund, and Unused Balances
Purchaser/Recipient refund requests for Services paid with a Gift Card will be treated in the same manner as standard refund requests. Where refunds are permitted by ATS, funds will typically be returned as Gift Card value (or less commonly to the original payment method) in accordance with applicable law. Refunds will be issued only to the original purchaser. Refunds will reflect the then-current ATS service rates. Gift Card balances can be viewed by the Purchaser via their Jane account or confirmed directly with ATS by phone or in-person. Unused balances will be held as client credit. Other than as described above, you may not return or cancel your Gift Card after it is purchased.
9. Lost or Stolen Cards
Please report lost/stolen cards or suspected fraud immediately to ATS customer service. The person presenting the Gift Card or entering the Gift Card code may be treated as its authorized user. ATS is not liable for unauthorized use absent negligence on its part.
10. Prohibited Uses
Gift Cards cannot be used as referral incentives, giveaways, or inducements. Gift Cards cannot be resold. Gift Card do not imply guaranteed outcomes or guaranteed Service availability.
11. Limitations of Liability
Gift Cards are not redeemable for cash except where required by law. ATS’ total liability with respect to a Gift Card shall not exceed the remaining balance on the Gift Card, except where prohibited by law. To the extent permitted by law, ATS will not be liable for indirect, incidental, special, or consequential damages related to Gift Card purchase or use.
12. General
- Personal information collected at purchase or redemption is used in accordance with ATS standard privacy practices, and incompliance with applicable laws.
- For Services delivered outside of Ontario, to the extent that local law imposes terms inconsistent with these Terms, those legal provisions will control. Otherwise, these Terms are governed by the laws of Ontario and federal laws of Canada applicable therein.
- ATS may update these Terms from time to time. Changes will be posted online; continued use of Gift Cards after publication of changes constitutes acceptance.
